Managerial Judging and the Evolution of Procedure, 53 University of Chicago Law Review 306 (1986)

Abstract

My thesis is that the evolution of managerial judging techniques
is an illustration of an evolutionary process in the law
which adapts existing structures to perform new functions-like
the panda's "thumb," or the common law precedents to which
Holmes referred.
