Ethical Opportunity in the Practice of Law, 27 San Diego L. Rev. 127 (1990)

Abstract

It is well known that the professional conduct of lawyers is governed
by an elaborate set of legal rules. It is also well known that the
actual conduct of lawyers, taken as a whole, falls short of what the
rules require. A criticism of the rules is that they countenance aggressive
and hurtful behavior that should not be permitted. Another
criticism is that lawyers, in their professional conduct, are not faithful
to the spirit of the professional rules, which reaches above and
beyond the letter of the law.
