This essay is adapted, by permission, from an article by the same name, published in the Virginia Law Review, volume 83, number 4. An earlier version was delivered to the constitutional court justices from fifteen countries who assembled for the first Global Constitutionalism Seminar held at Yale Law School in September 1996.
